Criminal Corporate Citizen The whole argument over somehow sudden legal access problems to the evidence in the supposed criminal investigation is dubious, as such provisions already exist with most modern political jurisdictions, along with the international cooperation and agreements, as far as the legal tools available in the democratic societies to deal with the crime and crime accessories, including gaining access to the evidence and the crime scene, with warrant or whatever other allowed means. The fact that the evidence is digital or stored in a vault somewhere or locked up in a hard drive is secondary to the fact that its status in such hypothetical criminal investigation is deemed of interest to the authorities, for whatever reason, and is evidence, and thus the authorities can legally demand access to either a physical property, a space or an item, a car for example, or a house, or if it is digital, then also access to the hard drives and so on, and in such case, both the citizen and the "person" corporation are subject to the law of the criminal code, which then grants the law enforcers the rights to do their job properly, and the rights of citizens and the status of the objects is then subject to such criminal investigations and the determination of the criminal justice system, not the corporations themselves deciding what the democratic governments of the world are out to do when investigating a crime and enforcing the law. After all, the citizens are subjects to the criminal code laws and laws of the world with all the rights and obligations as repercussions of it, and that's a whole another discussion on universal human rights/civil charter rights/ corporate shareholder/consumer rights, along with the bias of the corrupt governments in favour of small private interests over major public interests and essential priorities. So, to summarize, the argument that the government has no legal instruments to deal with the locked digital or otherwise property in the criminal investigations is unfounded, The fact that something is physical or digital does not absolve its potential legal status of interest in criminal investigation. The corporate structures are legal persons and like humans are subject to laws beyond their corporate charters and prime directives. Same as with the national laws that are based in part on the international laws, charters, and agreements. -30- Ministry of Foundation, Propaganda, and Membership Idiosyntactix Strategic Arts & Sciences Alliance --The Brand Name Of The Media Revolution! http://theUniverse.name/ Comment in response to: "The argument goes that if the FBI has a backdoored iOS, then it could, in fact probably would, fall into the wrong hands. This is valid. Now remember that Apple has a key that allows it to make such a backdoored OS, and if we doubt the FBI can keep data from getting into the wrong hands, why believe that Apple can? Now remember that you, the user and owner of the iPhone are not able to have a key, or even a passphrase, to prevent such an OS from being loaded, and you know the real reason that Apple doth protest too much: to maintain the legitimacy of their lock-in empire, to prevent breach, not by the FBI, but by you." ~ Dmytri Kleiner Idiosyntactix, Ministry of Foundation.
